Trial Consulting

Trial consulting involves social science, psychology, communication and economics to aid lawyers in the presentation of a case to insurance adjustors, opposing counsel, mediators and a jury. We all perceive facts through our own lenses based upon our life experiences, not necessarily the facts themselves. We help the trial team develop a case that joins the facts to human perceptions in meaningful and persuasive ways.

Our trial consulting services include case strategy consultation, mock trials, focus groups, witness preparation, and jury selection.

Our founder, Brent Gill has had extensive training in:

  • a. Neuro-linguistic programing (NLP). NLP is a psychological approach to communication that involves analyzing strategies used by successful individuals and applying them to reach a personal goal. It relates thoughts, language, and patterns of behavior learned through experience to specific outcomes.
  • b. David Ball technique. This approach to trying cases to a jury seeks to understand why jurors give, why they do not, and how to motivate them to achieve the proper result.
  • c. Reptile technique (Don Keenan). This technique analyzes and develops strategies that can address proper frames of mind to achieve the proper result.
  • d. AAJ Case Framing technique. This technique helps find fundamental truths that define a case, vital issues a jury just can’t get over, and how to echo those issues throughout the trial.
  • e. Trial Lawyers College technique. This technique uses psychodrama to help lawyers to look at their case, not as they’ve been taught, but, instead, through a far more vivid and multi-chromatic lens. It helps the lawyer find the story to tell with each phase of the trial.
